Greenwood Officer Violates Student's Rights

Recently, Circuit Judge Ashley Hines, stated that he would later state whether or not Officer Case Wiggins would be charged for stemming from a confrontation with a student at school. The 18 year old, named James Marshall was claimed to have been attacked by Officer Wiggins on December 6. Witnesses have stated that Marshall did nothing wrong before and during the time when Officer Wiggins had approached Marshall. Marshall's english teacher, Nokes, witnessed that Marshall looked "more angry than afraid" while speaking with Officer Wiggins.

As the school's camera captures Marshall and Wiggins confrontation together, it displays that Wiggins had put Marshall in a choke hold and later, pulled out his pistol and aimed it at his head. Marshall lawyer claims that "Wiggins, who was on patrol at the school, violated his [Marshall's] civil rights by using excessive force."

In my opinion, I think that this case should go in favor of Marshall. Although we don't know what the confrontation was about or what was said during that time, I still think that it is pretty unreasonable for Officer Wiggins to pull out a pistol and aim it to the student's head, especially while still on campus grounds. I believe that that act was very unnecessary and that Officer Wiggins could have handled the situation in a much more responsible way.

I agree with you completely! What a nut case. No cop should pull a gun on a student when the student clearly has no weapon, and is not trying to fight back. That cop should be fired, or better yet go back to cop school to learn how to handle the situation better.

Although it really depends on what the student was arrested for, I completely agree. Cops are taught to keep their cool and handle a situation with the right amount of force, but apparently this is not the case. The choke hold and the brandishing of the pistol was utterly and completely unnecessary as the student did not pose an immediate threat

Okay, the whole "choke hold" and bringing out his pistol is seriously unecessary for sure. I agree with you on this one. The officer could have done the job in a much more responsible way. But I'm only saying this because I'm reading that the student,Jamese Marshall, had done nothing wrong.

But I don't understand why the officer randomly attacked Marshall..?

I would definitely agree with the opinion that Marshall was being detained with excessive means. Just recently a video went out showing an officer putting a young girl in a chokehold and detaining many other boys with excessive force because they were skateboarding. He claims it was resist of arrest and other combined charges. To me, in this case and the one in this article, it seems unjust to allow officers any excuse without a reasonable means. Just because you're having a bad day, doesn't give you a right to implement that on others.

I also agree. Unless there is a life threatning situation, a police officer should not put the gun to a students head. He should have acted more maturely and handled the situation better.

yes the students rights were violated.

i also believe it is unreasonable for a police office to walk up to a student with no apparent reason and use exccessive force to restrain him

the police officer should be let off of duty and charged with attacking a student

I think it is ok for a police to do that if a person looks very suspicious bt other than that i don't think a teacher can just pick any random person and reatrain him.

I totally agree with you on this one. If Marshal did not do anything to provoke the officer what right does the officer have to choke a person a point a weapon at there head. This cop was just really crazy!!!

I think that the officer shouldn't have used force on Marshall. It's wrong for an officer to use force on a person if that person hadn't done anything wrong or assaulted the officer first. I feel that officers should only use force for self-defense or if the suspect doesn't listen to the officer. The officer shouldn't have attacked the person without justification or reasoning.

Crazy! The officer unless under immediate danger should not have pulled out the gun to a students head. That is a ridiculous act and was completely unnecessary. I hope we can get more information on the case and what really happened. I like how the evidence is on film so there are no discrepencies.
